A credit inquiry determines the ability of an individual or entity to repay a contracted debt. This investigation involves verifying that a person is indeed solvent and possesses the necessary assets to pay their creditor. This analysis and verification determine the assets and liquidity of the person subject to the credit inquiry.
Who Has the Right to Initiate a Credit inquiry?
Any claimant with a debtor has the right to initiate a credit inquiry. This type of investigation is particularly important for property managers, entrepreneurs, or other professionals who wish to conclude significant contracts with confidence. Such an investigation will always be conducted fairly and proportionately.
It is the lender’s responsibility to verify the borrower’s solvency according to Article L.311-9 of the Consumer Code. Therefore, the lender can be reassured by having the investigation carried out through a private detective, which will provide a guarantee in court in case of a dispute.
A client can also request their banker to conduct a solvency check on a drawee. The banker is free to hire a private detective and can justify their conclusions based on the detective’s findings without concern (see “Cour de cassation Chambre commerciale 9 January 1978, no. 76-13.107“).
