What is Client Diversion?

Client diversion is defined as a process that unfairly attracts part of a company’s clientele. This unfair practice can be committed by a current or former employee, or by a third-party company. This common practice results in unfair competition, specifically disorganisation (see “Reconsidering Evidence in Unfair Competition Cases“).

The most common forms of client diversion include:

  • A salesperson who exploits their relationship with clients to divert them for personal gain.
  • Breach of trust related to an unwanted supplier change by the client.
  • Diversion of client files.

Who is entitled to initiate an investigation in case of client diversion?

Any business owner or employer who suspects one of their employees, subcontractors, or competitors of diverting their clients is entitled to initiate an investigation. This investigation must always be conducted in a fair and proportionate manner.
